Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and HOKFAM Ltd ("Company," "we," "us," or "our") concerning your access to and use of our websites, mobile applications, and services (collectively, the "Services"). Purchases and Payments

Pricing

All prices are subject to change without notice. We reserve the right to modify or discontinue any product or service at any time. Prices displayed include applicable taxes unless otherwise stated.

Payment Processing

We use third-party payment processors (including Apple App Store, Google Play Store, and other payment gateways) to process payments. By making a purchase, you agree to the terms and conditions of these payment processors. We do not store your payment card information.

Subscriptions

Some Services may be offered on a subscription basis. Subscriptions automatically renew unless canceled before the renewal date. You authorize us to charge your payment method for renewal fees. Subscription fees are non-refundable except as required by law.

Refunds

Refund policies vary by product and platform. For mobile app purchases, refund requests are handled by the respective app store (Apple App Store or Google Play Store) according to their policies. For other purchases, please contact us at info@hokfam.com within 14 days of purchase to request a refund.

Disclaimers and Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Services will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of content

We do not warrant that the Services will meet your requirements or that any defects will be corrected. Your use of the Services is at your sole risk.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOKFAM LTD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or use
• Business interruption
• Personal injury or property damage
• Any other pecuniary loss

Our total liability to you for any claims arising out of or relating to these Terms or the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless HOKFAM Ltd and its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any User Content you submit.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, or in the courts of England and Wales if arbitration is not available or enforceable.

Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the Services will immediately cease
• We may delete your account and all associated data
• All provisions that should survive termination shall survive

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Services after changes are posted constitutes your acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced with a valid provision that most closely matches the intent of the original provision.

Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and HOKFAM Ltd regarding the Services and supersede all prior agreements and understandings.
